HUD to Formally Withdraw AFFH and Reducing Barriers Rules

In mid-January, HUD issued pre-publication copies of two notices in the Federal Register titled “Affirmatively Furthering Fair Housing; Withdrawal” and “Reducing Barriers to HUD-Assisted Housing; Withdrawal” respectively.
The Affirmatively Furthering Fair Housing (AFFH) proposed rule would have created a planning process and an enforcement mechanism to ensure that certain program participants complied with the duty to affirmatively further fair housing. The Reducing Barriers to HUD-Assisted Housing rule would have modified how admissions and termination regulations impacted people with a history of involvement with the criminal justice system.
For each of these topics, if HUD wants to issue a new regulation, it must do so with a new notice of proposed rulemaking and subject to the requirements of the Administrative Procedure Act.
