HUD Requests Comments on Build America, Buy America Act Waiver Form

By: Andrew Van Horn, Policy Analyst

Comments due February 20, 2024

On January 19, HUD published a 30-day notice of information collection regarding the Build America Buy America Waiver Request Form. The Build America, Buy America Act (BABA) requires agencies using federal financial assistance (FFA) on housing and real estate to purchase American-made iron and steel, construction materials, and manufactured items. As BABA begins to apply to many agencies in 2024, the waiver form will be an important tool because this law will represent a completely new requirement for most agencies.

See HUD OGC’s BABA website, HUD Exchange site, and NAHRO’s BABA comments for more background on the law, and please reach out to avanhorn@nahro.org to share questions or concerns about the form.
